This notice describes how medical and mental health information about you may be used and disclosed and how you can access this information.
Please review it carefully.
Your Rights
You have certain rights regarding your protected health information.
Obtain a Copy of Your Health Record
You may request an electronic or paper copy of your medical record and other health information maintained by LUMA.
In most circumstances, we will provide the requested information within the timeframe required by law. A reasonable cost-based fee may apply where permitted.
Request a Correction
You may ask LUMA to correct health information that you believe is inaccurate or incomplete.
We may decline certain requests when permitted by law, but we will explain the reason in writing.
Request Confidential Communications
You may ask LUMA to contact you in a particular way or at a particular location.
Reasonable requests will be accommodated when required by law.
Ask Us to Limit What We Use or Share
You may request that LUMA limit certain uses or disclosures of your health information.
We are not required to agree to every request.
When you pay for a healthcare service entirely out of pocket and request that information about that specific service not be disclosed to your health plan for payment or healthcare operations, we will honor the request when required by law.
Receive a Record of Certain Disclosures
You may request a list of certain disclosures of your health information made during the period allowed by law.
This list generally does not include disclosures made for treatment, payment, healthcare operations, or disclosures you specifically authorized.
Receive a Copy of This Notice
You may request a paper or electronic copy of this Notice of Privacy Practices at any time.
Choose Someone to Act for You
If another person has legal authority to act on your behalf, such as a legal guardian or authorized healthcare representative, that person may exercise applicable privacy rights for you. We will verify their authority before taking action when required.
File a Privacy Complaint
You may contact LUMA if you believe your privacy rights have been violated.
You may also submit a complaint to the U.S. Department of Health and Human Services Office for Civil Rights.
LUMA will not retaliate against you for filing a privacy complaint.

For certain types of information, you may tell us what you prefer.
This can include decisions about whether LUMA may:
share information with family members, friends, or others involved in your care
share information for disaster-relief purposes
use or disclose information for certain marketing purposes
use or disclose information in circumstances requiring your written authorization
If you are unable to communicate your preferences, we may share information when permitted by law if we believe doing so is in your best interest or is necessary to lessen a serious and imminent threat to health or safety.

We will disclose information when required to do so by applicable federal or state law.

We may disclose information to authorized health-oversight agencies for activities permitted by law, such as audits, investigations, inspections, or licensure activities.
Workers’ Compensation and Other Government Requests
We may disclose health information as authorized or required for workers’ compensation programs and certain other governmental functions.
Legal Proceedings and Law Enforcement
We may disclose health information in response to certain court or administrative orders, subpoenas, or law-enforcement requests when permitted or required by law. Additional protections may apply to mental health, substance-use, or other specially protected records.

Certain substance-use-disorder treatment records may receive additional protections under federal law, including 42 CFR Part 2. To the extent LUMA maintains information protected by Part 2, that information will not be used or disclosed for civil, criminal, administrative, or legislative proceedings against you unless the disclosure is permitted by applicable law, authorized by you where required, or ordered by a court in accordance with federal requirements.
Psychotherapy Notes
Psychotherapy notes receive additional protection under federal law. LUMA generally will not use or disclose psychotherapy notes without your written authorization except where specifically permitted or required by law.
Marketing and Sale of Information
